These terms govern access to and use of websites and online services operated by AlfaNest Labs ("we", "us") from France. By using our services, you agree to these terms. If you do not agree, do not use the services.
Services
We provide software tools and related documentation. Features, availability, and pricing may evolve. Certain features require an account and, where applicable, an active subscription.
Accounts
You are responsible for safeguarding credentials and for activity under your account. You must provide accurate information and keep it updated. We may suspend or terminate accounts for breach, risk, or legal reasons.
Acceptable use
You agree not to:
- Violate applicable law or third-party rights.
- Attempt to gain unauthorized access to our systems, other accounts, or data you are not permitted to use.
- Interfere with or disrupt the services, including by overloading infrastructure.
- Use the services to distribute malware, conduct fraud, or send unsolicited communications at scale.
- Reverse engineer our services except where mandatory law permits.
Customer content
You retain rights to content you submit ("Customer content"). You grant us a limited license to host, process, transmit, and display Customer content solely to provide and secure the services. You represent that you have the rights needed to submit Customer content and that its processing does not violate law or third-party rights.
Confidentiality and security assessments
If you use security scanning or analysis features, you must only submit systems and data you are authorized to test. You are responsible for compliance with applicable security testing rules and contractual obligations.
Fees and taxes
Paid plans are billed as described at checkout. Taxes may apply depending on your location and our tax configuration. Failure to pay may result in suspension of paid features.
Disclaimer
The services are provided "as is" to the maximum extent permitted by law. Automated security outputs are advisory and do not guarantee absence of vulnerabilities or compliance with any standard. You remain responsible for your own security posture and decisions.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability arising out of these terms is limited to the amounts you paid us for the services in the twelve months before the claim (or, if none, fifty euros), except where liability cannot be limited by law.
Indemnity
You will defend and indemnify us against third-party claims arising from your Customer content, your misuse of the services, or your violation of these terms, to the extent permitted by law.
Changes
We may modify these terms. If changes are material, we will provide reasonable notice where required. Continued use after the effective date constitutes acceptance.
Governing law and disputes
Unless mandatory consumer law provides otherwise, these terms are governed by the laws of France, and courts located in France have exclusive jurisdiction, without prejudice to mandatory provisions applicable to consumers in their country of residence.
